FAN TERMS OF SERVICE

INTRODUCTION

SirenDM is a technology platform that facilitates payment processing and content delivery between creators and fans on Telegram. By purchasing content through Telegram bots powered by SirenDM, you acknowledge that you have read and agree to be bound by these terms.

1. WHAT IS SIRENDM

We are a payment and delivery platform only:

• We process Telegram Stars payments between you and creators

• We deliver digital content you purchase via Telegram

• We provide technical infrastructure for creator-fan interactions

We do NOT:

• Create, produce, or control any content

• Verify, approve, or moderate content before delivery

• Verify the age of creators or performers in content

• Guarantee content quality, legality, or accuracy

• Act as a party to transactions between you and creators

Legal Relationship:

• Creators are independent third parties, not our employees or agents

• You contract directly with creators when purchasing content

• We are merely a technical intermediary facilitating the transaction

• All content liability rests with the creator, not SirenDM

2. ELIGIBILITY & YOUR RESPONSIBILITIES

You Must Be 18+ Years Old:

By using this service, you represent and warrant that:

• You are at least 18 years of age

• You are legally permitted to view adult content in your jurisdiction

• Adult content is not illegal where you are located

• You are using the service for personal, lawful purposes only

Important: We do NOT verify your age. Telegram does not provide age verification for bot interactions. You are solely responsible for ensuring you meet the age requirement. If you are under 18, you must stop using this service immediately.

Additional Requirements:

• You must comply with Telegram's Terms of Service

• You must have a valid Telegram account in good standing

• You must not be located in a jurisdiction where adult content is prohibited

3. HOW PURCHASES WORK

The Transaction Process:

1. You purchase Telegram Stars directly from Telegram (not from us)

2. You send Stars to the creator's bot to purchase content

3. We process the payment transaction through our platform

4. Content is delivered automatically to your Telegram account

5. Creator receives payment (minus platform fees)

Key Points:

• All transactions use Telegram Stars exclusively

• Telegram processes the Stars purchase (we don't see your payment details)

• Payment is final once content is delivered

• Transaction records available in Telegram Settings → Your Stars

4. PAYMENT & PRICING

Telegram Stars:

• All purchases use Telegram Stars only (no credit cards, no fiat currency)

• You buy Stars from Telegram (Telegram sets exchange rates and fees)

• Stars expire 3 years after purchase (per Telegram's policy)

• We have no control over Telegram's Stars pricing or fees

Creator Pricing:

• Creators set their own content prices

• Prices displayed in Telegram Stars

• Prices may change at any time at creator's discretion

• We do not set, control, or regulate pricing

5. REFUND POLICY

All Sales Are Final:

• Digital content cannot be returned once delivered

• No refunds for content you don't like, changed your mind about, or found unsatisfactory

• No refunds if you can't access content due to your own technical issues (device, internet, Telegram account problems)

Exceptions (Technical Delivery Failure Only):

We may issue a refund ONLY if:

• Technical failure on our platform prevented content delivery

• You contact us within 48 hours of purchase

• You provide transaction details (date, amount, creator name)

• We verify the delivery failure was our fault

Refund Process:

• Refunds (if approved) returned as Telegram Stars to your account

• Processing time: 7-14 business days

• Decision to refund is at our sole discretion

• Refund decisions are final and non-appealable

No Refunds For:

• Content quality, expectations, or subjective satisfaction

• Creator unavailability or slow response times

• Changes in creator pricing after your purchase

• Your financial situation or buyer's remorse

• Content being different than you expected

• Technical issues on Telegram's side or your device

6. WHAT YOU'RE BUYING

You Receive:

• A personal, non-exclusive, non-transferable license to view and access the content

• Digital content delivered via Telegram

• Access for personal, private use only

You Do NOT Receive:

• Ownership of the content

• Rights to redistribute, share, or resell content

• Copyright or intellectual property rights

• Any guarantee of content quality, legality, or accuracy

7. WHAT YOU CAN'T DO

Prohibited Activities:

• Share, redistribute, sell, or resell content to others

• Post content publicly or on other platforms/websites

• Screenshot or record content and share without creator permission

• Use content for commercial purposes

• Reverse engineer, extract, or copy content from bots

• Circumvent payment systems or attempt to access content without paying

• Harass, threaten, or abuse creators

• Use the service for any illegal purpose

• Impersonate others or create fake accounts

Consequences:

• Immediate account suspension or ban

• No refunds for suspended accounts

• Potential legal action by creators or SirenDM

• Cooperation with law enforcement if illegal activity detected

8. CONTENT ISSUES & DISPUTES

Creator Responsibility:

• Creators are solely responsible for their content (legality, quality, accuracy, appropriateness)

• SirenDM does NOT verify, moderate, approve, or guarantee content

• SirenDM does NOT verify performer ages or consent

• SirenDM does NOT verify that content complies with applicable laws

• We rely entirely on creator certifications and Telegram's reporting systems

If You Have a Problem:

For content issues (quality, expectations, creator behavior):

• Contact the creator directly via Telegram

• We are not a party to content disputes

• We do not mediate quality or satisfaction issues

For payment/delivery issues (content not received):

• Email: support@sirendm.app within 48 hours

• Include: Transaction date, amount, creator name, description of issue

• We will investigate technical delivery failures only

What We Can't Help With:

• Content quality or subjective satisfaction

• Creator-fan relationship issues

• Content legality (contact law enforcement)

• Disputes about pricing or content descriptions

9. YOUR DATA & PRIVACY

What We Collect:

• Telegram user ID (required for delivery)

• Purchase history and transaction records

• Messages sent to AI-powered bots

• Interaction data (timestamps, content accessed)

What We Don't Collect:

• Your payment card details (Telegram handles Stars purchases)

• Your phone number or personal contact information

• Your Telegram password or authentication details

How We Use Data:

• Deliver content you purchase

• Process payments and track transactions

• AI-powered conversations (messages processed by xAI Grok, OpenAI)

• Fraud prevention and security

• Compliance with legal obligations

Data Retention:

• Messages: 90 days, then automatically deleted

• Purchase history: 24 months or until you request deletion

• Transaction records: 7 years (tax compliance requirement)

Your Rights:

10. AGE VERIFICATION & CONTENT LEGALITY

Our Position on Age Verification:

• We do NOT verify fan ages (Telegram does not provide age data for bot users)

• We do NOT verify creator ages (creators certify they are 18+ and verify performer ages)

• We do NOT verify performer ages in content (creators are solely responsible per 18 U.S.C. § 2257 or equivalent laws)

You Acknowledge:

• By using this service, you self-certify that you are 18+

• We rely on your self-certification (we cannot verify it)

• If you are under 18, you are violating these terms and must stop using the service immediately

• Creators (not SirenDM) are responsible for verifying performer ages

If You Suspect Illegal Content:

• Report immediately to: abuse@sirendm.app

• We will investigate and remove content if necessary

• We cooperate fully with law enforcement

• CSAM (child sexual abuse material) is automatically detected and reported to authorities

11. ACCOUNT SUSPENSION & TERMINATION

We May Suspend or Ban Your Access If:

• You violate these terms

• You are under 18 years old

• You engage in fraud, chargebacks, or payment disputes

• You share, redistribute, or resell content

• You harass creators or abuse the platform

• We suspect illegal activity

• Telegram bans your account

Consequences of Suspension:

• Immediate loss of access to content and platform

• No refunds for suspended accounts

• Permanent ban for serious violations

• Potential legal action for illegal activity

12. THIRD-PARTY SERVICES

Telegram:

• All services operate on Telegram's platform

• You must comply with Telegram's Terms of Service

• Telegram processes all Stars purchases

• We have no control over Telegram's policies or enforcement

We Are Not Responsible For:

• Telegram outages, downtime, or service disruptions

• Telegram's enforcement actions (bans, suspensions)

• Telegram Stars expiration or loss

• Telegram's payment processing failures

• Changes to Telegram's policies or pricing

13. DISCLAIMERS & LIABILITY

SERVICE PROVIDED "AS IS":

SirenDM is provided without any warranties, express or implied, including but not limited to:

• Fitness for a particular purpose

• Merchantability

• Non-infringement

• Accuracy or reliability

• Uninterrupted or error-free service

• Security or data protection

We Disclaim All Liability For:

• Content: Quality, legality, accuracy, appropriateness, or safety of creator content

• Creator actions: Creator behavior, availability, pricing, or compliance with laws

• Age verification: We do not verify ages and are not responsible if minors access the service

• Performer ages: Creators (not us) verify performer ages per applicable law

• Third parties: Telegram outages, payment failures, or policy changes

• Data loss: Loss of content, data, or access due to technical issues

• Financial losses: Lost revenue, opportunity, or economic damages

• Indirect damages: Any consequential, incidental, special, or punitive damages

Maximum Liability:

Our total liability to you is limited to the amount of your most recent disputed purchase, not to exceed $100 USD equivalent in any case.

Your Assumption of Risk:

By using this service, you acknowledge and accept:

• Adult content may be offensive, explicit, or inappropriate

• We do not verify content legality or performer consent

• Creators may violate laws (we are not responsible)

• Service may be unavailable or interrupted at any times

• You use the service entirely at your own risk

14. INDEMNIFICATION

You Agree to Indemnify SirenDM:

You agree to defend, indemnify, and hold harmless SirenDM, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from:

• Your use of the service

• Your violation of these terms

• Your violation of any law or third-party rights

• Your misrepresentation of your age

• Content disputes with creators

• Your distribution or sharing of purchased content

We do not mediate content quality or satisfaction disputes

For Abuse/Illegal Content:

Response time: Within 24 hours for serious violations

16. CHANGES TO TERMS

We Can Update These Terms Anytime:

• Major changes: Posted on this page with updated date

• Continued use after changes = acceptance of new terms

• Check this page regularly for updates

17. DISPUTE RESOLUTION

Binding Arbitration:

Any disputes will be resolved through:

• Binding arbitration in the Czech Republic (or your home jurisdiction)

• Or through courts where you're located

• Small claims court (if you qualify)

You Waive:

• Right to class action lawsuits

• Right to jury trial

• Right to participate in class or collective action

18. GOVERNING LAW

These terms are governed by the laws of the Czech Republic, without regard to conflict of law principles.

19. SEVERABILITY

If any part of these terms is found invalid or unenforceable, the rest remains in effect.

20. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy, constitute the entire agreement between you and SirenDM.
